Legal Consultation for the Indigenous Peoples Energy Mining Activities
According to the Procedural Rules for the Implementation of Law Indigenous Peoples Consultation for Mining Activities in Energy, published by the MEM, in this work also involved the regional governments through the regional Energy and Mines. Consultation with indigenous peoples aims to reach an agreement with indigenous peoples on mining and energy sector measures specified in the regulations, may affect them directly. To this affect, the State should determine whether the interests of indigenous peoples will be directly harmed and to what extent.
The regulation states that the administrative measures for consultation in the mining sector include mining concessions, concessions, profit, general labor concessions and mining transport, which may directly affect indigenous peoples. The petitioner would be up to one year from the date that the petition asked for the presentation of basic information about the project. Upon receipt of this document, the regional government Infringement or appropriate, after verifying compliance with the requirements that must contain the basic information, start the consultation process.
Should the petitioner fail to file basic information about the project deadline, the regional government Infringement or declare the abandonment of the procedure and the free area as reported respondent. For the electricity sub sector, the materials to be submitted for consultation are temporary concessions and final power generation and transmission as well as granting permission for thermoelectric power generation.
